Facts

Plaintiffs claimed a declaration of title to certain property and possession, the trial judge found in their favour. The family land had been sold by members of the family without the authority of the family head and principal members which led to this action.

The defendants appealed to the Western State Court of Appeal and it was dismissed for lack of merit. The defendants thus appealed to the Supreme Court.
